Howell, Buchan & Strong and Your Real Estate Licensing Needs

Real Estate Agents and Brokers are governed by Chapter 475 of the Florida Statutes. The Department of Business and Professional Regulation and the Florida Real Estate Commission are responsible for licensing and regulating realtor and broker licenses.

Applications for Licensure

Practicing as a Real Estate Agent or Broker without a license is grounds for administrative discipline, but it is also a crime punishable by up to five (5) years in prison. To avoid unlicensed activity, it is important to consult an attorney to confirm whether you need a license or not, and if so what type of license you need. The application process is a nuanced and difficult process that is most successful with the assistance of experienced counsel. Licensure Renewals

If you hold an active or inactive Real Estate Agent or Broker license, HBS can assist you with renewing or reinstating that license. Once a license is issued it is not active forever. Licensure in Florida is rarely a one-and-done process. Generally, a license must be renewed every two (2) years. Further, if you hold an inactive license for too long, it is likely that you will have to start the licensing process from the beginning. Defend against Administrative Complaints (AC)

The AC process is not easy, it can be very stressful and nerve-racking for the Realtors and Brokers. Many agents and brokers receive ACs, but do not know what to do so they ignore them. Audits

The Department of Business and Professional Regulation conducts random audits. During audits, the Department inspects escrow accounts and validity licenses, among other things. The investigator is authorized to issue notices of noncompliance, and citations, or to file a complaint. It is important to maintain accurate and complete records as audits of those records can happen at any time.
